Terms of Service

1. Acceptance of Terms

By accessing or using Kome Together ("the Service"), operated by AMDS Software, Lda. ("we", "us", or "our"), you agree to these Terms of Service and our Privacy Policy. If you do not agree, do not use the Service.

2. Eligibility

You must be at least 18 years old to create an account and use Kome Together. By registering, you confirm that you are 18 or older and that you have full legal capacity to enter into these Terms. We reserve the right to terminate accounts where this requirement is not met.

3. Your Account

• You are responsible for maintaining the confidentiality of your login credentials
• You must provide accurate and truthful information when creating your account
• You may not share your account with others or create accounts on behalf of other people
• You must notify us immediately of any unauthorised use of your account at hello@amdssoftware.com
• One person may not maintain more than one account

4. Acceptable Use

You agree not to:

• Post false, misleading, or fraudulent activity information
• Harass, threaten, intimidate, stalk, or abuse other users
• Use the platform for commercial solicitation without our written consent (except as a verified Business Community)
• Scrape, crawl, or systematically extract data from the platform
• Attempt to gain unauthorised access to other accounts or our systems
• Upload content that infringes third-party intellectual property rights
• Use the Service for any illegal purpose under Portuguese, EU, or applicable international law
• Impersonate any person or entity
• Distribute spam, phishing content, or malware
• Use automated bots or scripts to interact with the Service

6. Activities and Safety

Kome Together connects people for outdoor and sports activities. By participating you acknowledge:

• Physical risk: outdoor and sports activities carry inherent physical risk. You participate entirely at your own risk
• No supervision: we do not organise, supervise, or control any activities listed on the platform
• Organiser responsibility: activity organisers are solely responsible for the activities they create, including safety, equipment, and compliance with local regulations
• Participant responsibility: you are responsible for assessing your own fitness, skill level, and the suitability of any activity before joining
• Kome Together is not liable for any injury, loss, or damage arising from participation in any activity listed on the platform

7. Content You Post

You retain ownership of content you post (photos, descriptions, messages). By posting, you grant Kome Together a non-exclusive, worldwide, royalty-free licence to display, store, and transmit that content solely as necessary to provide the Service. You represent that you have the right to post such content and that it does not violate any third-party rights or these Terms.

We reserve the right to remove any content that violates these Terms or our community standards at any time without prior notice. We may also disable or terminate the account of any user who repeatedly violates these Terms.

8. Content Moderation and Reporting

We operate a user-driven reporting system. You can report any content or user that you believe violates these Terms directly from within the app. Our moderation team reviews reports and may:

• Remove the reported content
• Issue a warning to the user responsible
• Temporarily suspend or permanently ban the user's account
• Report the matter to law enforcement or designated authorities where legally required

Pursuant to the EU Digital Services Act (Regulation 2022/2065) and applicable Portuguese law, we will report any detected or reported Child Sexual Abuse Material to the Polícia Judiciária, the Internet Watch Foundation (IWF), and Europol's EC3.

9. Business Communities

Business Communities on Kome Together are subject to additional verification requirements. Business Community organisers must not mislead users about the nature of their business or services. Commercial activities conducted through Business Communities must comply with all applicable Portuguese and EU consumer protection laws.

10. Termination

We may suspend or terminate your account at any time for violation of these Terms, with or without notice. Accounts found to contain or distribute content prohibited under Section 5 will be terminated immediately and permanently. You may delete your account at any time from Settings. Upon termination, your personal data will be anonymised as described in our Privacy Policy.

11. Digital Services Act (DSA) Compliance

Kome Together complies with Regulation (EU) 2022/2065 on a Digital Single Market (Digital Services Act). As an intermediary service provider, we:

• Maintain a transparent notice-and-action mechanism for reporting illegal content
• Do not use targeted advertising based on profiling
• Do not serve advertisements to users who we know to be minors
• Report CSAM and other illegal content to designated authorities as required
• Provide a single point of contact for authorities: hello@amdssoftware.com

12. Limitation of Liability

To the maximum extent permitted by Portuguese law, Kome Together and AMDS Software, Lda. are not liable for any indirect, incidental, special, or consequential damages arising from your use of the Service, including damages arising from activities organised through the platform. Our total liability to you shall not exceed €100 in any 12-month period.

Nothing in these Terms excludes liability for death or personal injury caused by our negligence, fraud, or any other liability that cannot be excluded under applicable law.

13. Governing Law and Disputes

These Terms are governed by the laws of Portugal. Any disputes shall be subject to the exclusive jurisdiction of the courts of Portugal, without prejudice to your rights as a consumer under EU law. For consumer disputes, you may also use the EU Online Dispute Resolution platform at ec.europa.eu/consumers/odr.

14. Changes to Terms

We may update these Terms at any time. We will notify you by email at least 30 days before material changes take effect. Continued use of the Service after the effective date constitutes acceptance of the new Terms.
